1) Introduction

All orders will be subject to acceptance in accordance with the following Terms and Conditions of Sale.

Land Rover & 4x4 Sales Gloucester is a trading name for Cropcare Consulting Ltd, and acceptance of your order and the completion of the contract between you and Cropcare Consulting Ltd will take place on dispatch of the vehicle(s)/equipment to you (i.e. at the point you collect the vehicle(s)/equipment from our premises or we deliver the vehicle(s)/equipment into your custody, the custody of your appointed third party, or the custody of a shipping or transportation agent), unless we have notified you that we do not accept your order or you have cancelled that order (please see the 'Deposits, Placing Orders, Cancellations' section below).

Please print out these terms and conditions for your own records.

2) Deposits, Placing Orders, Cancellations

We may take a £500 holding deposit to hold a specific vehicle in your name. This holding deposit provides you with ten days (from the point we receive the £500) in which you can; arrange to view the vehicle(s)/equipment, gather any further information you require from us regarding the vehicle(s), equipment or shipping/export/import process, and/or select any additional equipment or extras you would like to add to your order. This £500 holding deposit will be deducted from the cost of the vehicle if you proceed with the purchase. The deposit will be refunded if we are unable to complete the order, or the vehicle is found to be faulty or inaccurately described.

At any point within the ten day holding period you are entitled to transfer your deposit to another vehicle. You may do this a maximum of three times, but the ten day period may not be extended.

At (or prior to) the end of the ten day holding period you are required to finalise the details of your order and pay a 20% of total order value down payment on standard vehicles and a 50% of total order value down payment on modified vehicles.

Once your down payment has been paid, your order is ‘locked’ and we will begin allocating resource in order to prepare the vehicle to the agreed specification. You will be unable to change or amend your order after the down payment has been paid.

If, before the end of the 10 day holding deposit period, you have not paid the down payment, your £500 holding deposit will be forfeited and your order will be cancelled.

Once the vehicle(s)/equipment are fully prepared and ready to be shipped, you will be required to clear your outstanding balance in full. You will only become the owner of the goods once we have received full payment. Once the vehicle(s)/equipment are no longer in our custody, they are held at your own risk and we will not be liable for their loss or destruction.

3) Pricing & Payment Methods/Terms

The price you pay for a vehicle(s) is the price agreed with you at the time we receive your 20% / 50% down payment. While we try and ensure that all advertised prices are accurate, errors may occur and/or the final criteria of your order may require an adjustment to the pricing.

If we discover an error in the price of the vehicle(s)/equipment you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it with a full refund. If we are unable to contact you, we will treat the order as cancelled. Holding deposits can be made securely over the telephone or at our premises with credit or debit card. No credit or debit card details are retained by us at any time. When paying the 20% / 50% down payment or remaining balance of your order, credit cards will attract a surcharge of 2.5% of the value paid by credit card. You can also make payment via a direct bank transfer. No surcharge will apply to direct bank transfer payments. We do not accept cash, banker’s drafts, or cheques. Please contact us if you require our bank account details in order to make a bank transfer payment.

Your order will not be processed until the 20% / 50% down payment is received.

4) Shipping & Export

When placing any order for export, any shipping charges or duties are not included in the price of your order.

We will ensure the vehicle is correctly removed from the UK registry (DVLA) V5.

If agreed as a separate part of your order, we can arrange the transportation of your vehicle and for it to be safely handed in to the custody of a third party shipping or transportation agent. This transportation to a UK port loading area or shipping agent can be arranged at an additional charge. We will not accept any liability, or cost associated with the consequences arising thereof, any damage or fault arising with your vehicle(s)/equipment once that vehicle(s)/equipment has left there custody. We strongly recommend you take out independent shipping insurance.

it is not possible to guarantee a specific time frame for the departure or arrival of any shipping vessel, so we will not be held accountable for any cost, inconvenience, or delay associated with this element of the shipping process.

Due to the constantly changing dynamic of vehicle import legislation, any information provided by us regarding the importation process, vehicle restrictions, charges or criteria are given as a guide only. You must ensure that you have contacted the relevant local authorities and that you are satisfied that your order is suitable for exportation/importation.

Cropcare Consulting Ltd will not be held accountable, or accept the return or refund thereof, of any vehicle which fails to meet importation regulations except when we have prepared or shipped the order in a manner which contravenes the criteria agreed between us when you placed the order.

You must ensure that any specific importation actions, that you might request us to undertake on your behalf (regardless of whether or not those actions are included within our advertised pricing or information) are agreed in writing/email with us prior to placing your order. We will not be held accountable if you fail to have identified and/or asked us to organise such an action.

Our advertised pricing does not include any clearing or importation costs or duties. You must ensure you understand these charges and can pay them separately when requested by the relevant authority. Usually, importation charges will be calculated by the value/type of vehicle(s)/equipment in question. Cropcare Consulting Ltd accepts no liability for any aspect or cost of the exportation/importation process.

When exporting a vehicle from the UK, you will become the legal owner of the vehicle(s)/equipment once the order has been paid in full. Once your order has been safely handed over to the third party to be loaded on to the shipping or freight vessel/vehicle, the vehicle(s)/equipment purchased will be held at your own risk and we will not be liable for its loss, damage or destruction.

10) Vehicle Warranty

Cropcare Consulting Ltd offers a three month mechanical failure warranty on all vehicles under ten years of age at point of sale. If a vehicle is older than ten years of age at point of sale, a warranty can be purchased at an additional cost. This warranty does not affect your statutory rights.

This warranty is only valid for mechanical and electrical failure in the United Kingdom.

Under the terms of our warranty, we are entitled to choose whether to repair or replace a component covered by the warranty. Items that are covered under our warranty are listed in the warranty booklet (viewable on request prior to purchase).

Mechanical or electrical failure is defined in the ‘Definitions’ section of the warranty booklet. There is no limit on the number of claims made under this warranty save that the total value of claims shall not exceed the purchase price of the vehicle. The maximum claim limit for any single claim is £1,000.

Where the cost of repair exceeds £1,000 (excluding VAT), the extent of contribution by Cropcare Consulting Ltd under the terms of this warranty is the stipulated Claims Limit. The period for which this warranty is valid is from the date of purchase for the period/mileage (whichever is sooner) as stipulated on the ‘Warranty Record’ and is equivalent to 3 months or 3,000 miles of usage since the point of purchase.

To maintain the validity of our warranty, the vehicle must be maintained and serviced as recommended by the vehicle manufacturer or to an alternative service content as authorised by us and evidenced by completion and stamping of the Servicing Record in the back of the warranty booklet. The relevant invoices must also be retained and may be required in the event of a claim. A maximum allowance of 500 miles or one calendar month is permitted (if unavoidable) in excess of the manufacturer's recommended servicing interval.

All warranty issues must be notified to Cropcare Consulting Ltd within foty-eight (48) hours of the problem having been identified. Cropcare Consulting Ltd reserves the right to carry out warranty repairs in house or through an agreed third party. All warranty claims will be invalidated if remedial works are completed by a third party if Cropcare Consulting Ltd has not previously authorised in writing a quotation from that third party. Without prior authorisation from Cropcare Consulting Ltd, all costs associated with the claim or repair will fall to the customer.

In the event of a repair being carried out under the terms of this warranty, any parts replaced shall become the property of Cropcare Consulting Ltd, and we are at liberty to specify the use of reconditioned/exchange units for repairs carried out as a result of a valid claim within the terms of this warranty.

This warranty is invalidated if the vehicle is used for rallies, racing, pacemaking, reliability trials, scrambling, speed testing, track days or for hire or gain, or commercial travelling without the express written consent of Cropcare Consulting Ltd.

This warranty is only transferable to another owner if Cropcare Consulting Ltd expressly consents to it in writing.

This warranty is invalidated if it is discovered that the odometer has been disconnected for a material mileage or tampered with.

This warranty is only valid for mechanical and electrical failure in the United Kingdom.

If a warranty claim requires that the vehicle be transported or recovered from roadside or to any repair centre (including Cropcare Consulting Ltd premises), Cropcare Consulting Ltd will not be held liable for any associated costs (including transportation, disruption to customer travel plans, associated delays, replacement vehicles, road side recovery, or any other associated costs).

This warranty does NOT entitle the customer to the use of a loan vehicle while any warranty issue is being resolved either through Cropcare Consulting Ltd or a nominated third party. Cropcare Consulting Ltd will always endeavour to resolve any warranty issue as quickly and conveniently as possible, but customers must make their own arrangements, and meet the costs thereof, of a temporary or replacement vehicle/mode of transport during the repair period.

11) Returns, Cancellations & Replacements

You are encouraged and afforded every opportunity to inspect any vehicle(s)/equipment at our premises or to request data, photographs, an independent inspection by a third party, or independent advice from a third party prior to placing any order with Cropcare Consulting Ltd.

As some of our vehicles are customised and prepared specifically to your specification, and once your 50% down payment has been received, you are not entitled to any partial or full refund if you cancel your order (except in circumstances where Cropcare Consulting Ltd has failed to satisfy its obligations under the Sales of Goods Act 1979 (Revised) or is unable to complete the order).

Please do not place an order with Cropcare Consulting Ltd unless you are 100% satisfied that the vehicle(s)/equipment is fully suitable for your needs and you fully understand the import and registration process and costs.
